While the new law changed the procedures and some of the eligibility requirements, most people who file under the new law will achieve the same result as those who filed under the old law. The best estimates available suggest the results to be the same for 85-90% of applicants.

Chapter 13: Re-organize For a Brighter Future

  • Chapter 13 Bankruptcy Protection allows eligible people to restructure their debts, sometimes paying them off completely and sometimes paying some and wiping away others. This can be useful in dealing with debts not covered by Chapter 7 bankruptcy, such as taxes or court fines. This also can allow you to catch up on a mortgage or car payment over time.

Chapter 13 is for consumers and is the most common form of reorganization but Chapter 12 (for farmers), and Chapter 11 (for businesses) are also options that remain available.
